Abstract
Nowadays, technology plays an important role in our daily life. There is an increasing
number of people using electronic communication devices. Business operators also use
technology to help advertising and marketing their services and products. The data profiling
is one of the technologies that is commonly used by business operators as a tool for
collecting and analysing the data in order to predict demand of their customers. Although
the data profiling can provide advantages to business operators, its function has posed
many challenges to the Personal Data Protection Law in protecting the right to privacy of
online users. This is because the process of data profiling involves collecting the personal
data of online users and this collection may not comply with the data protection principles.
For example, the data subjects may not provide explicitly consent for such personal data
collection and they may not have the right not to be subject to a decision based solely on
automated processing, including data profiling, which produces legal effects concerning
them. According to the Thai Personal Data Protection Act B.E 2562, there is no specific
principle for protecting the data subject’s rights in the context of data profiling. As a result,
this paper will explore the legal challenges of personal data protection in the context of
data profiling. The EU Personal Data Protection Law will be explored with a view to suggesting the appropriate approaches for addressing such challenges. These approaches
aim to protect the right to privacy of the data subject and also not to pose undue burdens
on private and public sectors or discourage them to use technology.
