In the Chapter of *Court and Judicial Process”, there has been a great effort in establishing the “Rule of Law” to clarify the required conduct for standardized transparent, accountable judicial process as well as the requirement of the assurance for the independence of the judiciary, namely the imposition of the disciplinary punishment for the judicial misconduct. Further, as the assurance for the human resource management within the judicial organ, the human resource management system requires the committee representatives of judges and eminent persons of at least one third of the total number of the committee. There have also been requirements of assurance and establishment of standards for the human resource management system of the prosecutor organ as of the judicial organ, particularly the prohibition to take a position in state enterprises or other state business, as the assurance for the independence of the prosecutor.
With respect to the judicial organ, especially the Constitutional Court, the Nomination Committee for the judges of the Constitutional Court has been improved to be more transparent and appropriate. With respect to the Court of Justice, the Court of Appeal and the Court of Appeal of
