Abstract

A criminal trial in the court of first instance is one of the important processes of a
criminal justice system. As it is a process where the ‘truth’ of the case is established by
the plaintiff, the defendant and the court. Normally, during a criminal trial in Thailand, the
judge would conduct a voice-recording during the witness examination. Thereafter, the
recording would be transformed to a written record, in which the judge would summarise
the witness statements. So far, the visual and audio recording of a criminal trial has not
yet been introduced under Thai law, although, in some specific circumstances the
broadcasting of visual and audio during a criminal trial has been allowed.
The research has shown that in some jurisdictions, the visual and audio recording
has been conducted in a criminal trial in the court of first instance, with some restriction
of the usage depends on each jurisdiction. This is because there are both advantages and
disadvantages. As for the advantages, the visual and audio recording of a criminal trial
could ensure that justice would be done, it could also show the society that a criminal
trial is conducted fairly according to the law. And if there is a disputation regarding the
trial, the recording could act as evidence to settle such disputation. However, the visual
and audio recording of a criminal trial could affect defendant’s rights as well as witnesses. This article aims to analyse advantages and disadvantages of the using of visual
and audio recording in a criminal trial in the court of first instance by conduct a comparative
analyse between related law of Thailand, United Kingdom (England and Wales) and
United States law, in which in the two latter jurisdictions, the law regarding the issue is
enforcing. Thereafter, the result of the comparative analyse would be used to reform the
law of Thailand.
